Standard Competition Terms.

General
1.1. CulchieComps, operates competitions which are skill-based competitions resulting in the distribution of prizes in accordance to the terms and conditions detailed on this website.
1.2. Through entrance of this competition via any entry route, entrants are deemed to have read, understood and accepted these Terms and Conditions and agree to be subject to these terms.
1.3. This competition is open to entrants of the age 18 and over and are not employed by the promotion.
1.4. On entry of any competition, entrants may be asked to submit all contact details as per request of the promoter which will be used to:
(A) Notify the winner that they have won the prize.
(B) To post proof of the winning entry on the promoters website and social pages.
1.5. Entrants are solely responsible for providing and updating the promoter with the correct contact details and it is not the promoters responsibility to update unless prompted by the entrant.
1.6. The promoter takes no responsibility or liability for any failure or inability to contact any entrant due to incorrect information provided by the entrants, however the promoter will endeavour to make communication through the contact details and social pages with the entrant.

Competition
2.1. As a condition on entering the competition, entrants must ensure that, by doing so, they do not contravene any laws in their country of residence. The promoter will not be liable in any way if an entrant enters the competition unlawfully. The entrants and the promoter recognise that the competition, its administration and all associated activities are governed by UK and Northern Ireland Law and the promoter and entrants recognise that the county or high courts of Northern Ireland shall have exclusive jurisdiction in the event of a dispute arising out of the competition or its administration.
2.2. Upon entry to the competition, entrants acknowledge that upon competition of their entry requirements for the competition, in no way guarantees that they will win the prize(s).
2.3. Only entries completed in full, containing the correct answer as agreed by the promoter will gain entry to the competition. Failure to correctly answer any question correctly will still result in the entrant being charged.
2.4. The promoter does not guarantee the value of any prize(s) or its condition on the time it will be gifted to the competition winner, however we endeavour to provide a fair and clear description on each prize.
2.5. CulchieComps do not in any way guarantee the value of the Prize, its condition or roadworthiness at the time the prize is exchanged with the winning entrant.
2.6. Upon entry in a competition online via the website and acceptance of these terms and conditions you confirm you do not contravene and laws of your country of residence regarding the legality of entering our competitions. The promoter will not be liable for any entrant entering any of the promoters competitions unlawfully.
2.7. The promoter reserves the right to disqualify or refuse entry to any entrant if there are any grounds for believing that an entrant has broken or breached any of the terms and conditions or acted in a way that is perceived to be illegal by the promoter.
2.8. Entries to the competition(s) will become the property of the promoter and will not be returned.
2.9. In the event that a competition concludes early, either a cash prize will be offered which is equivalent to the entry fees total income minus 30% for administration fees and all operational expenses or store credit for the value of the entry fees total income minus 30% for administration fees and all operational expenses will be offered to the winning entrant.

CulchieComps have the right to oversell by 1% if technical issues allow this to happen. CulchieComps will attempt to not allow this to happen however if it does there is a 1% buffer for every competition.

Entry
3.1. Through answering the unique question associated with each competition, the entrant recognises that they must exercise skill, knowledge and judgment to give the correct answer.
3.2. Entrants can buy a maximum of 10 tickets per transaction and 50 tickets per competition.
3.3 A free entry route is available by entering the competitions in the following way:
- Go to the Website and select the competition you wish to enter to view the Competition Question;
- MUST BE SENT VIA POST OR WILL NOT BE ENTERED
- Send an unenclosed postcard to 62 Mountain Road, Newry, BT35 7QG containing the following information:
- The competition you wish to enter;
- Your full name and postal address;
- Telephone number and email address;
- Your date of birth;
- Your answer to the Competition Question.
- Please note free delivery does NOT apply to any free postal entry winner. The fee for delivery will be discussed at time of win.
- The entrant may use a MAX of 10 free postal entries per annum.
3.4 IMPORTANT INFORMATION REGARDING FREE ENTRIES:
(a) Free entries are limited to one per person per competition.
(b) Free entries are treated in the same way as paid entries and those who answer the competition question correctly have an equal chance of winning a prize.
(c) Free entries must be received by the Promoter at least 48 hours prior to the Closing Date. Any free entries received after this date will not be processed and correct entries will not be entered into the draw.
(d) If free entries are received after the maximum number of entries for the competition has been reached, they will not be processed and correct entries will not be entered into the draw.
(e) It is the Entrant’s sole responsibility to ensure that their entry is received by the Promoter in advance of the deadline.
(f) The Promoter is under no obligation to confirm whether or not an entry was received prior to the deadline or whether the Entrant’s answer to the Competition Question was correct.
(g) Any free entry not complying with the entry requirements contained in clause 3.3 shall be disqualified and not entered into the draw.
3.5. To complete in full an entry to a competition, the entrant will be asked to provide their contact details or register to / sign into their online account and card payment details for the entry fee. Once an entry is submitted the card used for the transaction will be electronically approved through our payment merchants.
3.6. The competition will close when the maximum number of entries and/or the closing date us reached, although the promoter reserves the right to extend the closing date by 6 weeks, on two separate occasions for each competition at their discretion.
3.7. All entries to competitions are final and no refunds shall be made for any reason, except in the case where the promoter cancels the competition. The promoters decision is final and no correspondence will be entered into about the results of a competition(s) following the winner being selected in accordance with our Terms and Conditions.
3.8. Entrants agree that consumer protection (Distance Selling) regulation 2000 does not apply to the promoter and delivery of goods will be on a per competition basis.
3.9. Entries will NOT be accepted from the following countries – USA, Canada, Norway, Turkey, France, Poland, Japan, Sweden

Competition end
4.1. In the event that a competition concludes and the number of entries does not match the maximum number of entries at the final and closing date of the competition, the promoter will either close the competition and deem if the entries is sufficient to award the prize or a cash prize or store credit will be offered to the winning entrant.
4.2. The promoter will retain 30% of the entry fees to cover administration. The remaining balance following deduction of the 30% plus operational expenses is the prize fund which will then be offered to the winning entrant.
4.3. If the promoter can not make contact with the winning entrant within 7 days of the competition being concluded and drawn, through the contact details provided and social media, the promoter then reserves the right to select an alternate winner who will have 7 days to accept the prize. The original winner will have no legal claims to the prize once the alternate winner has been selected.

Choosing the winner
5.1 The winning entrant will be chosen through the online Random Number Generator through Google and this will be streamed live through our Facebook page.
5.2. Full competition details will be confirmed through our Facebook page and website.
5.3. Entry lists for each competition will be available through our website and or our Facebook page. Details such as draw date & time will also be available.
5.4. There will be one or more winner for each competition and this will clearly be explained on the competition page on both our socials and our website.
5.5. Once the competition is completed and the winner has been in contact with the promoter, the prize will be delivered by the promoter to the winner of the competition.
The legalities of each prize (VC5, Certificate of authentication etc) (if applicable) will be handed over on receipt of the prize and it will become the responsibility of the prize winner(s) to fulfil the remaining legal steps to compile with the laws of their residential country (e.g. Taxing, Insuring, Registering themselves as registered owner and keeper).
5.6. Winner’s details, including full name, postal address and contact number/email may be shared with our underwriting bank. They may contact winners at random for verification and auditing purposes.
5.7. On receipt of prize, all winners must furnish a copy of photographic ID and a utility bill dated within the last 3 months.
5.8. Winners must sign a waiver acknowledging receipt of the prize and that CulchieComps have no further obligation for the repair or maintenance of same.

Prize(s)
6.1. The promoter remains the legal owner of any prize from the start of the competition until it is handed over to the winner.
6.2. The promoter does not offer or accept any value valuation of a prize and all prizes are subject to the terms and conditions of the prize provider, manufacturer or supplier and law of the residence country.
6.3. The prize will only be the prize which is awarded at the time of the draw and no alternatives will be offered thereafter.
6.4. Collection / Delivery of the prize will be dealt with on a per prize basis, this will be communicated with the customer on each case. Free delivery throughout Ireland – small charitable donation can be made at winner’s discretion. Delivery can be arranged throughout UK for a fee.
6.5. Any winner who has not paid for their entry and has won via like and share or by postal entry, the prize must be collected or can be delivered for a fee.
6.6. The winner will be required to provide full proof of identity and entry to the competition prior to the prize being delivered or collected. This must occur within 21 days from the date of the draw for the prize. If this does not occur the winner will not receive the prize.
6.7. Winners of prizes which contain livestock must have access to an appropriate herd/ flock number.

Privacy Policy
7.1. The promoter and entrants recognise that the promoter may use personal data, provided by and belonging to the entrant as defined by the Data Protection Act 1998, to facilitate the operation of each competition according to these terms and conditions.
7.2. The entrants and promoter recognise that the promoter may also disclose this information to relevant third parties for the purpose of the prevention of fraud, money laundering, legal or other financial regulatory reasons.
